Does CPSC eFiling apply to de minimis (Section 321) shipments?

Yes. CPSC says any product requiring a certificate must have an eFiled certificate regardless of shipment value. What that means for small parcel and direct-to-consumer sellers.

The problem

Many small sellers ship low-value parcels straight from overseas. CPSC's eFiling FAQ is clear: any product requiring certification must have an eFiled certificate, regardless of the value of the imported shipment. There is no Section 321 (de minimis) exemption for eFiling.

CPSC also says Disclaim message sets are not required for any shipment, but encourages filers to send them for products that don't need certificates, as this may improve the shipment's risk score.

How to fix it

  1. Identify which of your parcel SKUs need a CPC or GCC.
  2. Ask your carrier or logistics provider how they collect CPSC certificate data for parcels.
  3. Prepare certificate data per product (or a Product Registry record) before shipping.
  4. For products outside CPSC jurisdiction or not needing a certificate, ask about sending a Disclaim.

Check your documents before you resubmit

Upload your CPC or GCC and the test report. The free pre-check compares identifiers, cited rules, lab, dates and certifier across the documents and returns a red/amber/green list of what to fix.
