CPC for baby gates and enclosures: 16 CFR 1239 testing and Amazon documents

Which certificate baby gates and enclosures need (CPC), the CPSC rule (16 CFR 1239), lab requirements, Amazon document notes and the mismatches that get resubmissions rejected.

The problem

Which certificate

A Children's Product Certificate (CPC), based on testing by a CPSC-accepted third-party lab, because these are children's products (designed or intended primarily for children 12 and under).

Rules to check (verified on eCFR)

Children's products generally also face lead limits (substrate and surface coatings). Toys and child care articles face phthalate limits (16 CFR 1307). Which apply depends on your materials and the age grade. Confirm with CPSC's Regulatory Robot and your lab. Don't cite a rule your report doesn't cover.

Durable infant or toddler product: check whether this product type is listed in 16 CFR 1130. Listed products need a product registration card and permanent marking.

Lab

Children's product testing must be done by a third-party lab accepted by CPSC for each rule you cite. Look up the lab ID on CPSC's accepted-lab search and confirm 16 CFR 1239 is in its scope.

Amazon notes

Amazon may ask for a CPC, the full test report and product images. For toys it may route the request through Direct Validation (see our Direct Validation guide). Reviewers compare the documents with the listing, so the model, product name, manufacturer and photos must agree.

Common rejection mismatches for baby gates and enclosures

How to fix it

  1. Confirm the product type and age grade, and which of the rules above apply (Regulatory Robot, then your lab).
  2. Test at a CPSC-accepted lab whose scope includes 16 CFR 1239, plus any lead/phthalate tests that apply.
  3. Issue the CPC (or GCC) in your company's name as importer, citing only rules covered by passing results.
  4. Line up model, product name, manufacturer and photos across the listing, report and certificate. Then run the free check.
